Claiming accident compensation as a Litigation Friend

When making a claim for someone who is less than 18 years of age, because that person is legally a minor, then any claim must be conducted through a person known as a litigation friend. It is the responsibility of the litigation friend to conduct the case in the interests of the child involved. This is very similar to making a claim yourself, except that if any accident compensation is awarded, it will be placed in a special high interest account by the court, which can only be accessed by the child once they reach 18 years of age.

Claiming for an accident when you were a child

If you suffered an accident when you were aged less than 18, you may still be able to make a claim for personal injuries compensation. This is because the normal 3 year limit on making a claim after an accident is applied differently to cases were a person had an accident as a child. In these cases the 3 year limit only starts on the person's 18th Birthday; this means that you have until you are 21 to make a claim.
