After an accident – don’t lose out on your car’s value

Claiming money for loss of value of a motor vehicle

It’s a situation nobody wants to find themselves in; you’ve had an accident, you’ve been injured and your car’s been damaged.  If you’re reading this, then you probably know that an expert road accident solicitor can help you to make a no-cost compensation claim to recover money for the injuries you have suffered and for the damage to your car.  You might even know that you can get your car repaired, at no cost to you, and claim the money back from the other driver’s insurance company.  But did you know that you can also claim for any of the loss in value of your vehicle from before the accident compared to after it has been repaired.

When calculating the financial impact of a car accident, an expert road accident solicitor will not just look at the obvious losses you might have suffered, such as the immediate damage to your vehicle or the time you took off work to recover from your injuries.  In order to make sure your claim accurately reflects the total cost of your car accident, your solicitor will also look at the other less obvious you might have lost out financially, such as something known as diminution in value.

Simply put, diminution means loss; in this case it refers to the loss in value of your vehicle that happens when it has to be repaired following an accident.  Regardless of the car, or indeed the quality of the repairs that are made to it, being involved in an accident and being damaged will have affected its value.  Even if the repairs to your car mean that it looks identical to another car that was not involved in an accident, the mere fact that it has had to be repaired will mean it will be worth less than the undamaged, unrepaired car.

This loss in the value of your car can be included as part of your claim.  For example, if your car had been worth £10,000 before the accident and after being repaired it was only worth £8,000, then it would be possible to claim for all or part of the £2,000 value that you had in effect lost from the value of your car as a result of your accident.
