Claiming compensation for defective/faulty products
Each year in the UK, thousands of people are injured as a result of defective or faulty products they have purchased. Whether it is a chair collapsing when you sit on it, an item of electrical equipment malfunctioning and burning you or even problems with specialist equipment such as diving gear and physical training equipment. Here are some examples of the kinds of accidents that Camps Solicitors can help you to claim faulty product compensation for:
- Cuts and bruises caused by defective appliances or equipment
- Damage to hair and scalp from products used in hairdressing salons/hairdressers
- Car accidents caused by faulty workmanship
- Injuries to children caused by playing with defective toys
- Injuries caused by exploding bottles and cylinders
- Injuries caused through the taking of unsafe "medicinal" products
Claiming faulty product compensation against a manufacturer, importer or retailer
Under the Consumer Protection Act 1987, if a product causes injury, the manufacturer (or the importer) is responsible. However, if the retailer cannot tell you who the manufacturer or importer is, the retailer will be held responsible.
You may be able to claim personal injury compensation if faulty goods cause injury or damage to property (as long as the damage amounts to at least £275). However you cannot make a compensation claim if the item or product was purchased more than 10 years ago.
To claim faulty product compensation from the manufacturer or importer, you have to prove that the product was defective, (meaning it was less safe than you could reasonably expect, not just that it was of poor quality), and this was the reason that it caused your injury. Camps Solicitors can organise independent expert confirmation to show that the damage was caused by the product being defective.
If you were injured and the injury was not your fault (i.e. you did not misuse the product), then it's very likely you will have a claim for accident compensation.
If a product has caused serious injury to you or your family, you will need specialist legal help from a personal injury solicitor. Here at Camps Solicitors, we can pursue an accident compensation claim for you against the manufacturers of any defective product that might have injured you.
