Council pays out to crash victim for uncut hedge

Plants on central reservation obscured views of oncoming traffic in taxi/car collision

A 54 year old woman has successfully claimed part of her personal injury compensation claim from a local council, after her lawyers successfully argued the council owed her a duty of care to trim trees that had obscured the view of a road junction where she was knocked down.  The accident, took place in Dalston in North London; as Pervin Yetkin was crossing the road she was hit by a taxi.  The accident left her with life-threatening injuries.

The latest ruling comes from the Court of Appeal, where Mrs Yetkin had appealed against an earlier ruling that Newham Council was in no way to blame for the accident back in 2004.  Delivering their verdict, the three judges said that despite Mrs Yetkin’s own negligence being largely responsible for the accident, the council should pay 25% compensation for her injuries.  The amount of compensation she is eligible to receive will be assessed by another court.

Mrs Yetkin’s accident took place on 13th February 2004 as she was crossing Stratford High Street.  On the central reservation of the road were several bushes and small trees.  As Mrs Yetkin was crossing the road, her view of oncoming traffic was partially blocked by the hedgerow on the central reservation.  This meant that she did not see the taxi that knocked her over until it was too late.  Mrs Yetkin suffered several serious injuries including a fractured neck and a number of internal injuries.
