A young moped driver struck from behind by a Jaguar XJ6 aged only 16 has been awarded a compensation package that could total £4million. Carl Hannay was left with horrific injuries and permanent brain damage after being knocked off his moped near Basingstoke in 2003. The force of the impact was so strong that Mr Hannay’s crash helmet actually flew off before his head hit the road, leaving him unprotected.
Mr Hannay’s claim for compensation was complicated by an accusation made by the Jaguar driver’s insurance company that his helmet had not been properly fastened before the accident. The insurers contested the claim on these grounds, meaning that Carl, now aged 22, has had to wait six years to find out whether the ongoing costs of his care, estimated at between £45,000 and £75,000 a year for the rest of his natural life, would be met by a compensation settlement.
The provision of 24 hour-a-day care and assistance to an injured person will usually only be required in cases where the victim has suffered the most severe level of physical injuries. In Mr Hannay’s case, the brain damage resulting from his accident has left him needing constant supervision, with the demands of his care increasing as he grows older, especially as in his case, the accident had virtually no effect on his life expectancy.
