Injury claims made easy

If you have been injured, making a claim can often seem very daunting. Many people who are perfectly entitled to make an injury claim or claim for damages never actually do so because of fears that they will have to pay out money, the claim will take up too much of their time or that it will be years before they receive any compensation.

6 simple steps to make an injury claim

1. When you first contact us we will ask you a few simple questions about the accident or injury you have suffered. These questions are to help us understand your accident so that we can decide whether you have a good case for claiming compensation. This first phone call usually takes about 20 minutes. Don't worry if you do not have every detail of who was involved in the accident and who was responsible, we can get most of these details at a later stage.

2. If we decide that you have case for making a personal injury claim we will then appoint one of our personal injury, road accident or workplace accident solicitors to handle your case. All our solicitors and legal executives are highly qualified and have many years experience of handling accident compensation claims cases, they will discuss all your options depending on the type of claim you wish to make.

3. From now on your solicitor or legal executive and their team will work on your behalf to put together all the evidence for your injury claim. They will get witness statements from people who saw the accident, records from the police or your employer. A photographer will be assigned to take pictures of the accident location to be used as evidence. Any other evidence relevant to the compensation case will also be collected.

4. To make sure that the injury claim you receive reflects the impact your injuries have on daily life, we will often ask you to keep a record of how you are coping, and whether you feel any treatments or medications you are receiving have helped you. About 4 months after your accident we will arrange for you to see an independent Court approved medical specialist at a hospital near to where you live. The specialist will examine your injuries and ask you some questions about how you are coping. A medical report will be prepared and this will be an important piece of evidence to support your injury claim.

5. We will now discuss all the different types of compensation you may be eligible for, including compensation for:

  • Compensation for the pain and suffering
  • Any costs and expenses e.g. phone bills, prescriptions, treatment for your injuries
  • Any other financial losses e.g. loss of income, lost or damaged property
  • Compensation to reflect the impact of the accident on your life
  • Compensation for any future care if your injuries will continue to affect you

6. A total figure for the amount of personal injury compensation to be claimed will then be calculated by your solicitor. This figure will be sent to the insurance company of the person who was responsible for causing your accident. We will then negotiate with the insurance company until we reach agreement on an amount for your compensation award. Most cases settle without the need to go to the courts, but if we cannot reach agreement with the other side's insurance company then we may take your case to court to secure the best possible compensation award.
