One of the key terms when talking about tripping and slipping claims, and accidents in general is “reasonable”, i.e. could reasonable steps have been taken to avoid the accident that caused your injuries.
In the case of slipping accidents, where a substance has been spilt or left on the floor where your accident occurred, then you could have a case for claiming compensation against the person or organisation that was responsible for making sure the surface you slipped on was clean. In cases such as these, the claim can come down to whether it was reasonable to expect that the spillage or substance which you slipped would have been cleaned up before your accident. The longer the spillage had gone unnoticed before you slipped on it, the greater the chance that you will have the grounds to make a claim.
A similar principle applies to tripping accidents caused by defects in the pavement or floor surface you tripped on. If there was a defect that you could reasonably have expected to have been fixed at some point after the damage occurred and before your accident happened, then you may very well have the grounds to make a claim for compensation. A lot depends on the location of your accident, heavily used areas such as leisure centres and busy shopping streets are generally expected to be maintained to a higher standard compared to rarely used footpaths or side streets.
Where a tripping accident was caused by an obstruction such as wires on the floor, then again a court would look at whether it was reasonable to expect the obstruction to be removed or signposted if it could not be removed. A court judging a tripping compensation claim will also look at how visible an obstruction was, as well as how far it stood up or stuck out from the floor surface.
