Woman sues Knowsley council for exposure to asbestos at school

Camps Solicitors were interested to read about the case of a 48 year old woman from Merseyside who has launched a lawsuit against her local council for exposing her to asbestos whilst she was at school in the 1970’s, causing her to develop the fatal asbestos related cancer mesothelioma.  The case against the local council is believed to be one of the first of its kind in the country.

The woman attended a school in Huyton near Liverpool between 1972 and 1978.  As originally designed her school had an open plan layout, but noise from other classes meant that the local authority commissioned workmen to add internal walls to the building, separating the individual classrooms.  The woman’s allegation is that during this work, materials including asbestos were used, and a quantity of asbestos dust was produced which settled on surfaces throughout the school, contaminating the building.

Her claim states that as a result of exposure to this asbestos dust, the woman developed the terminal cancer Mesothelioma – in which tumours affect the lining of the lungs and the abdomen.  The cancer is primarily and almost exclusively caused by exposure to asbestos fibres, and the average length of time between diagnosis and death is only 12 months.   The case is due to be heard at Liverpool County Court early this year.
