Compensation claims through the Motor Insurers' Bureau
According to figures from the Association of British Insurers (ABI), there are around 1 million uninsured drivers on the road in England and Wales. Between them, these drivers are responsible for 50,000 road traffic accidents every year. The combined cost of these accidents to insured motorists is estimated to be around £500 million a year, adding an extra £30 to the average insurance policy.
The Motor Insurers' Bureau was set up in 1946 as a measure to compensate the victims of negligent uninsured and untraced drivers. The scheme is paid for by contributions from all the insurance companies and is designed to pay out as a last resort where compensation cannot be claimed from another source. It is restricted to paying out compensation for injures and damage to property, although as part of your claim Camps Solicitors can also recover the cost of any replacement hire vehicle, if it is appropriate in your circumstances.
What should I do if I have been in an accident caused by an uninsured driver?
Uninsured drivers are involved in an accident on average every six months. They are also ten times more likely to drink and drive, and three times more likely to be convicted of driving without due care and attention. If you have been involved in a car accident that was not your fault and it is safe to do so, then there are a few things you can do to increase the chances that your claim will be a success:
- Write down details of the other person's vehicle, including the make and model of the vehicle and the registration number. You should also note the other driver's name and address.
- Record what the other driver says so that you have a record of what was said - in the event that the driver is traced they may deny being involved in the accident.
- Take notes about the damage to the other car and the accident scene.
- Remember to note road markings, road signs, light and weather conditions and whether the other car had its lights on, the more detail you can get at the time the better the chances of making a successful compensation claim.
- Take the details of any independent witnesses to the accident so that they can be contacted to provide their evidence. If you have a camera or camera phone, take pictures of the scene of the accident, including pictures of the other driver and his or her vehicle.
These points also apply to accident involving insured drivers, by providing your solicitor with as much information as possible at an early stage in your claim, you increase the chances of getting compensation, and the extra information will also help your claim to progress more quickly.
