Excel Europe Limited and Imperial Tobacco fined £80,000

Two companies have been fined a total of £160,000 following the death of a man at work.

Gary Brooks, who was 42, was a heavy goods driver with logistics company Excel Europe. He was collecting a load from Imperial Tobacco Ltd in Nottingham when he was fatally injured.

It was back in 2007 when Mr Brooks was trying to attach a loaded trailer from Imperial to his cab.

However as he was trying to do this, the lorry gradually rolled forward, trapping him between the front of the vehicle and a building, resulting in him suffering fatal head injuries.

In court, it was revealed that drivers often did not put their brakes on to make sure their vehicles were safely parked before attaching loads and had not been properly trained or assessed and no checks had been carried out on the use of brakes.

Excel Europe Limited was fined £80,000 and ordered to pay costs of £35,800, while Imperial Tobacco was also fined £80,000 and ordered to pay costs of £31,000.

Mr Brooks’ family could now make an accident compensation claim, in an attempt to ease just some of the pain and loss that they’ve suffered.
