The High Court in London has just approved what is believed to be the highest ever compensation settlement for someone of retirement age after a payout of nearly £3 million was approved for a 74-year-old woman who was left with severe brain damage after a car accident. The woman in question, Pamela Olive Green, a successful businesswoman with substantial income from a number of companies linked to her property development business, was left unable to continue her role after the accident.
Mrs Green was knocked down whilst she was walking her dog, a standard poodle, across Hampstead Heath in north London. The driver of the car that knocked her down was sued for failing to pay adequate attention as he approached the crossing. He argued that Mrs Green and her dog “ran onto” the road giving him no time to react – a claim that would have been disputed by Mrs Green’s legal team had the case gone all the way to trial. However the case was settled out of court without an admission from the driver that he was liable for the accident.
The huge size of the settlement, around £2.8 million, is unusual for someone of retirement age and is usually only awarded to people in their 20’s who might require decades of specialist medical care and compensation for a lifetime’s lose earnings. However in Mrs Green’s case, the settlement reflected her substantial income and the fact that she had played an active role in running her business up until the day of the accident. Mrs Green’s barrister spoke after the case, saying: “It’s a big settlement – It’s the biggest one you’ll find in this type of case for someone of this age.”
